Employer Withholding Your Wages or ID Documents? Here's What's Illegal

Holding onto your Aadhaar or passport as "security" isn't a normal HR practice — it's a red flag with real legal consequences for the employer.

An employer confiscating your identity documents (Aadhaar, passport, voter ID) to prevent you from leaving a job is not a lawful employment practice — it's a recognised marker of forced labour / bonded labour situations, which are separately and seriously criminalised.

Withholding earned wages as a form of control or punishment is also illegal under wage-payment law — you're entitled to timely payment for work already performed, regardless of any dispute over notice periods or contract terms.

If this is happening to you, the Labour Commissioner's office and local police can both act — and in serious bonded-labour-pattern cases, the District Magistrate has specific rescue and rehabilitation powers under a dedicated law.
