Home BNSS Explained Appeals After a Verdict
§413

Victim's Right to Appeal

Plain-English Summary — Not Verbatim Statutory Text

Gives a victim an independent right to appeal — separate from whether the State/prosecution chooses to — against an order acquitting the accused, convicting them of a lesser offence than charged, or imposing what the victim considers inadequate compensation.

  • This exists specifically so a victim's ability to challenge an outcome doesn't depend entirely on the public prosecutor's decision to appeal or not.

If you're a victim and disagree with an acquittal, a downgraded conviction, or the compensation awarded, you personally have standing to appeal it — you're not just dependent on the State doing so.
